The Sims and Preliminary Lien Notice

Overview
Now if the construction industry would be as simple as direct as building a house in The Sims, a lot of lawyers are going to lose a lot of money making businesses.

The Sims – Building a house

Building a house in The Sims is simple, you select the stuff you want to build – walls, windows, doors, sanitary wares fittings etc. Choose where you want to lay them, the items magically appear in the desired spot and money (Sims’ currency) is automatically deducted.

Reality – Building a house
In the physical realm, the real world, the reality where we live in, it is not that simple of course. To build a house, you need to own a piece of land, get various local authority approvals, engage various professional Consultants – Architects, Engineers of various fields namely civil and M&E (Mechanical and Electrical) and various Contractors to construct the said building.

Payment do not occur automatically, most of the time the clients (mofo who wants to have a building constructed) are not very swift with the payment that should be rightfully paid to the rightful parties (the ones who are involved in the building construction – consultants and contractors) so when payment issues arises these parties involved can refer to the contract they signed earlier.

Contractors, Sub-Contractors and Suppliers
So what happens if there is no direct contract? Like the Sub-Contractors and Suppliers do not have a direct contract with the client, what can they do in the event of payment problems? What they ought to do is to serve a preliminary lien notice.

Preliminary Lien Notice
To put it simply, Sub-Contractors and Suppliers must serve a Preliminary Lien Notice if they did not receive payment for their works or materials that they have provided so that they can proceed with the rightful claim of the monies that is owed to them.

A Preliminary Notice is a document used by the Claimant (Sub-Contractors, Suppliers) to inform the Client (mofo that owns the property), the Main Contractor and the Construction Lender – If the Claimant did not receive payment for their works or materials provided, they (Claimant) have the legal right to do stuff to file various claims against the Trio (Client, Main Contractor and Construction Lender) and the Trio would face various legal actions.

A Sub-Contractor or Supplier doing business in California can check out the preliminary lien notice services offered by the PROLIEN company should they be in need of it.

Deimos is a Quantity Surveyor graduate, his Dad has been running a construction business in the local building construction field for more than a decade and to be frank, Deimos believes that most big time building developers suck. They suck as in they are bloody leeches who suck away the monies that ought to be paid to the various building contractors.

Over here in Malaysia, the local construction industry is so bad, that most of the time them local contractors over here are paid zilch by them local developers. Bloody Sons of Bitches.

Oh by the way, local Quantity Surveyors are paid zilch for their employment too. The monthly salary just sucks. Fresh graduates are exploited by firms at every corner.
